Congressman Max Miller Under Fire for Sharing Nude Image of Daughter in Legal Battle with Ex-Wife

In a shocking turn of events, Rep. Max Miller's ex-wife, Emily Moreno, has filed a lawsuit against the Ohio congressman, accusing him of recklessly distributing a nude photograph of their 2-year-old daughter as part of a collection of documents released to clear his name amid ongoing scandals. The lawsuit, obtained by Us Weekly, was filed in an Ohio court and alleges that Miller, 37, and his attorney Aaron Minc are liable for the release of the explicit image.

The image was reportedly part of a February 2025 text exchange between Miller and Moreno discussing custody arrangements, when Miller asked to see a photo after Moreno mentioned their daughter had a bruise – later determined to be from a broken collarbone. In her lawsuit, Moreno, 32, argues that Miller is liable for paying $150,000 for every disclosure or transfer of the image under federal law and could face criminal penalties in Ohio for illegal use of a minor in nudity-oriented material.

Miller's attorney Minc previously took responsibility for accidentally releasing the photo, explaining that he missed it while combing through the documents sent by the congressman. However, Miller has defended the release, stating that the photo was already part of an ongoing investigation by Child and Family Protective Services and was being taken out of context.

The photo's release comes amid a wave of negative publicity for Miller ahead of his reelection bid in November's midterm election. Senator Bernie Moreno, Emily's father and fellow Republican politician, publicly denounced Miller following the release of the naked photo, calling for him to resign. Earlier this week, reports emerged that President Donald Trump's White House team personally intervened to ask Ohio Republicans to stop pressuring Miller to end his reelection campaign for the state’s 7th Congressional District seat.

The House of Representatives’ Ethics Committee has opened an investigation into Miller’s conduct and the results of the ethics probe are still pending. If found guilty, Miller could face severe consequences, including expulsion from Congress. This latest scandal adds to the growing list of allegations against Miller, which include domestic abuse and misconduct charges.
