Surrogate's Defiant Delivery Sparks Multi-State Legal Battle Over Baby Boy Gabriel

In a dramatic turn of events, McKenna West, an Alaskan surrogate, gave birth to a baby boy named Gabriel on Wednesday, despite a bitter legal dispute with the intended California parents. The birth occurred early in the Dallas area, as West refused to terminate the pregnancy after doctors discovered her fetus had hypoplastic left heart syndrome (HLHS), a rare congenital heart defect requiring three surgeries upon birth, according to Boston Children's Hospital.

The original surrogacy agreement included a clause allowing the parents to choose termination in case of an "anomaly," but West stood her ground and relocated to Texas, where she would be recognized as the birth mother, as reported by The Dallas Morning News. Initially due on September 2nd, Gabriel arrived earlier than expected amidst the ongoing court battle.

The intended parents' legal team, led by attorney Lee Budner, shared that their priority is ensuring Gabriel receives immediate medical care and they can spend valuable time with him during this critical period. The couple has filed a lawsuit against McKenna West, with a court date scheduled for later this month. The complex legal battle between the parties has unfolded across multiple states, as Texas Attorney General Ken Paxton intervened to secure emergency court orders compelling two Dallas hospitals – UT Southwestern Medical Center and Children's Medical Center of Dallas – to provide life-saving care for the newborn.

In response to this unique case, McKenna West's attorney, Lincoln Wilson, claimed that the termination clause in the surrogacy contract is "offensive to state and federal law."
